This Privacy Policy ("Policy") explains how we collect, use, disclose, and safeguard your data in compliance with applicable Indian laws, including but not limited to:

  • Website Usage: IP address, browser type, device information, cookies, and browsing history (via Google Analytics or similar tools).

  • Communication Data: Emails, calls, and messages exchanged with us.

We collect this data directly from you (e.g., forms, consultations), third parties (e.g., banks, credit bureaus), or automatically through our website.

  • Directly: Through intake forms, consultations, emails, phone calls, or during court proceedings.

  • From Third Parties: From empanelled banks (e.g., Punjab National Bank, Union Bank of India), credit agencies, or public records for due diligence in NPA recovery.

We do not collect data from children under 18 without parental consent, in line with DPDP Act protections.

Your data is used solely for legitimate purposes under the DPDP Act and IT Act:

  • Service Delivery: To provide debt recovery, enforcement, resolution, and litigation services under SARFAESI Act and DRT/DRAT.

  • Compliance: To fulfill legal obligations, such as KYC under RBI guidelines or court disclosures.

  • Communication: To send updates, notices (e.g., under Section 13(2) of SARFAESI), or newsletters (with opt-out option).

4. Sharing and Disclosure of Information

We share data only when necessary and with safeguards:

  • Service Providers: Trusted vendors (e.g., cloud storage like AWS India, secure email providers) bound by NDAs and SPDI Rules.

  • Empanelled Entities: Banks like Bank of India for NPA cases, under strict confidentiality.

  • Business Transfers: In case of merger or acquisition, with notice to you.

We do not sell your data. International transfers (if any) comply with DPDP Act adequacy requirements.

5. Data Security

We implement reasonable security practices under SPDI Rules, including:

  • Encryption (AES-256) for sensitive data.

  • Access controls (role-based) and firewalls.

  • Regular audits and employee training on data protection.

  • Breach notification within 72 hours to the Data Protection Board of India (DPIB) and affected users, as per DPDP Act.

Despite these measures, no system is 100% secure; we disclaim liability for unauthorized access beyond our control.

6. Data Retention

We retain data only as long as necessary:

  • Client Files: 8 years post-engagement (or longer if legally required, e.g., under Limitation Act, 1963).

  • Website Logs: 6 months.

  • Sensitive Data: Deleted upon purpose fulfillment or consent withdrawal.

Data is securely destroyed (e.g., shredding, overwriting) when no longer needed.

7. Your Rights

Under DPDP Act and IT Act, you have rights to:

  • Access: Request a copy of your data.

  • Correction: Update inaccurate information.

  • Erasure: Request deletion (subject to legal holds).

  • Withdrawal of Consent: Opt-out anytime (e.g., unsubscribe from emails).

  • Grievance: Lodge complaints with our Grievance Officer or DPIB.
